The auctions and the correlated services supplied by Industry Zone, through the web site, the service delivering are regulated by the present Terms and Conditions. Entering or using the services or the web site or being recorded, neither as a buyer, nor as a seller, the user declares the following:
- to have read the Terms and Conditions,
- have understood the Terms and Conditions
- be bound by the Terms and Conditions as far as it regards the use of Services and web site. If the user does not accept the Terms and Conditions he can not proceed to the use of Services or web site. In case of not understanding the Terms and Conditions it is necessary to contact Zoneindustry, by sending an e-mail to the following address info@zoneindustry.com. The Terms and Conditions, together with additional terms and conditions specific for particular auction, constitute the complete contract between Zoneindustry and user, regarding the object of the contract itself and they substitute any previous or contemporary agreements between the parts regarding the object.
LOTS DESCRIPTION
1. Zoneindustry treats only the auction organization and execution without providing any guarantee regarding lots quality and it will not be able in any case be entitled of responsibility for possible vices, difference and / or it is deficiencies in auctioned property.
The lots are presented / exposed in an interesting way with one or several days before the auction, and therefore the auction catalogues, flyers, insertions etc. have purely an indicative value with the purposes to individualize the lot and Zoneindustry declines then each responsibility for possible involuntary erroneous or incomplete descriptions of the auctioned property.
2. Each lot will be considered sold in the state in which the auctioning is taking place, at the f buyer's discretion, as well as the place it is located.
3. Cables, extracts, water-supplies, connections and accessories generally etc., be underground and / or visible and / or accessible, utile or necessary for the auction purpose, even if pertinent to the same equipment, will be considered excluded from the lot, as a different specific indication in the special conditions of the auction or communication during the auction.
4. Some machinery auctioned might ask , subject to law regulations, for a marking European Community (CE). The machinery without marking European Council is put on sale with the condition that the buyer who intends to use them or to retail them in a state of the European Union takes charge of their regularization according to the current laws applied to the Country.
AUCTION ORGANIZATION
1. The organization, the preparation and the execution of the auction are entrusted to Zoneindustry.
2. The auction will be held in the order set up in the catalogue / in the special conditions of the auction, but Zoneindustry withheld the right for itself to deviate from such an order, in any moment, without any notice and it can not involve responsibility towards cession.
3. The properties auctioned are only those expressly marked or numbered.
4. Zone industry, is guaranteeing the good order and the result of the auction, also withhelds the largest discretion for itself on auction managing, therefore, before or during the auction, it will have the right, also without giving a motivation and while this will not involve any responsibility towards cession:
- to qualify an offer as non-valid;
- to exclude from the auction one or several participants;
- to combine the goods in one lot, to separate the lots and to withheld lots or goods from the auction, without announcing any party involved.
REGISTRATION
The Services and the Web site are exclusively available for the persons able to act properly to conclude the present Contract. Zone Industry can, at its sole exclusive discretion, to refuse to accept the registering of a person (or juridical person) and can, in any moment after the acceptance of the registration, refuse the permission of a person (or juridical person) to keep using the Services and the Web site for any reason.
SALING WAYS
1. The auction takes place exclusively on a public technological Internet platform, with faculty, for Zone Industry, to present offers on behalf of third parties
2. The best offering individuals are bound to the best offers.
OFFERING MODALITIES
1. Any made offer is unconditioned and irrevocable.
2. In the case when a single offer derives from several subjects, the last ones are responsible in solid of the offer itself and of respecting the obligations derived from the participation in the auction.
OFFERS PRESENTED BY THIRD PARTIES - TRYING TO PRESENT AN OFFER
1. The subject that which makes a concrete offer to the auction, even if he declares to act on behalf of a third person, is personally responsible for the offer itself, as well as for the observance of all the obligations derived from the participation in the auction.
2. Zone Industry has the faculty, at its own discretion, to accept the tentative to make offers by third parties, in the full respect of auction total conditions, general and particular as well as further conditions established by Zone Industry itself, and in each case, Zone Industry can not be held responsible way in case of involuntary errors or carelessness in the execution of the received tries.
In the case of acceptance of a try of making an offer, Zone Industry reserves, between other, expressly the right of asking the offering subject to make a previous payment as a whole sum to offer, to insure the offer.
In the same way Zone Industry expressly reserves the right to refrain from the execution of the tentative of making the offer, in the case in which the description, in the catalogue of the auction, of the lot or of the combination of lots exists deviation from the auction course.
ZONE INDUSTRY'S ROLE
Zone Industry supplies the Services and the web site in the extent that sellers can offer articles for sale and buyers can place offers to purchase them. In this sense, Zone Industry neither is directly interested in transactions, nor is it not an agent of the buyer or of the seller. Zone Industry has no power to transfer the title of any article offered buy sellers. Since it does not participate in any arrangement, Zone Industry does not supply, and even more it must not be understood that it have been supplied, any declaration or guarantee regarding the quality, the certainty or the legality of the offered articles, nor on the veracity or accuracy of any offer. Besides, Zone Industry does not supply any declaration or guarantee of any type regarding the will or the ability of the buyer or of the seller of improving a sale in the respect of the Contract. It is an exclusive responsibility of the buyers and sellers to make an independent research the solvency of the users with whom they co-operate, or with which they might co-operate in future, an arrangement, as also the condition or the possible descriptions of an article object of a possible arrangement.
For any controversy inherent or deriving from the above written the competence will belong exclusively to the Court of Milan. And then the Italian text of the present General Conditions has priority, in case of difference of interpretation the translation in English, French, and Spanish, enclosed please.
AWARD
1. From the moment of the award the buyer is incumbent of risks related with the loss of the good / goods awarded, while the property of same passes to the buyer only subsequently on the payment of the whole price of purchase.
2.Zone Industry reserves the right, between other, expressly the right, at its own discretion, not to make any award or to subordinate the award and / or the delivery of the lot awarded with further fulfillment indicated in the special conditions of auction or bulletins during the auction.
REVOCATION OF ARICLES - AUCTION INTERRUPTION
The user recognizes and accept that the articles within the auction can be revoked or sold before or after the end of the designated auction period, that the auction can be suspended, other temporarily or permanently and that the auction, at the exclusive Zone Industry's discretion can be extended over the predetermined auction terms; all this can happen without notifying the user. In general, the offered articles will be sold at the biggest offer; provided that, still, some articles are auctioned at smaller prices of a minimum reserve and / or are subject to the right of confirmation of the Seller.
Zone Industry reserves the right to refuse any offer that represents only a small advantage / surplus compared with previous offer, that is not rated to the value of the offered article or that Zone Industry is presumed to have been done it illegally or in bad faith. However, Zone Industry can present offers to the auction neither on behalf of itself, nor on behalf of third parties. The offers made by a representing person will be considered offers of third parties and not of Zone Industry.
SERVICES MODIFICATIONS
The user recognizes and accepts the fact that Zone Industry can change, modify, amend, suspend or interrupt any aspect of the services or of the web site, at any moment, without notifying and without obligations towards the user or third persons. Zone Industry reserves the right for itself to impose limits to some services functioning or of the web site, at any time, without an informative notice and without obligations towards the user or third persons.
The user recognizes and accepts that Zone Industry can amend all or any part of Terms and Conditions (included expenses and rules of arrangement), at any moment, to its exclusive discretion and without any informative notice. Any modification of Terms and Conditions will be applied back on the web site. The user is invited to examine periodically the Terms and Conditions of Zone Industry published on the web site.
Services and web site using constitutes acceptance of the Terms and Conditions, including possible modifications.
EXCLUSION OF ARTICLES
Zone Industry allows exclusively the sale of personal property or industrial machinery, equipment and properties in excess. Zone industry can, at its exclusive discretion, remove from the web site properties that, according to its opinion, do not constitute personal property. The sale of illegal or improper articles is forbidden severely.
PASSWORD PROTECTION
After being registered the fact of using the service or the web site, the user will be asked to chose a user name and a password.
